Welcome to Emovur, operated by Audentrix Pvt. Ltd. ("Emovur", "Company", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of our website, software applications, platforms, WhatsApp APIs, digital marketing services, and all related products and services available through https://emovur.com.
By accessing, registering for, subscribing to, or using any of our Services, you ("Customer", "User", "Client", "you", or "your") acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue use of our Services or products immediately.
1. Services
These Terms apply to all services provided by Emovur, including but not limited to:
- WhatsApp Business API Solutions
- Social media marketing
- Search engine optimization (SEO)
- Google and Meta ad management
- Web design & development
- CRM and CHATapp
- WhatsApp Business API integration and campaign management
- SaaS tools for customer support and automation
- Any other products or software solutions offered by Emovur
Note: Emovur provides businesses with a software platform to manage and automate communication via the official WhatsApp Business API. Our platform facilitates message delivery, automation, and integration services, but we do not own or control the WhatsApp platform, Meta, or any third-party service providers connected to the WhatsApp ecosystem. Our services are provided based on client requirements and project agreements.
2. User Responsibilities
- You must provide accurate business information and content.
- You are responsible for ensuring the legality of your advertisements, campaigns, and website content.
- You agree not to misuse or reverse-engineer any of our proprietary software tools or systems.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must ensure all information provided during registration is accurate and kept up to date.
- Unauthorized use of another user's account is strictly prohibited.
3. Intellectual Property
All content, designs, and software tools developed or provided by Emovur remain the intellectual property of Audentrix Pvt. Ltd., unless explicitly transferred in writing. Clients retain ownership of their brand assets and materials provided to us for use.
All content, software, trademarks, and materials available on the Emovur platform are the property of Emovur or its licensors. You are granted a limited, non-exclusive, non-transferable right to use the platform as per these Terms.
4. Payments and Subscriptions
- All payments for services are agreed upon in advance and invoiced accordingly.
- Subscription-based services (such as SaaS tools) are billed monthly or annually, as per plan.
- Late payments may result in suspension or termination of service.
- All subscriptions are prepaid and billed in advance based on the selected plan.
- Payments once made are non-refundable, unless explicitly agreed to and communicated in writing by Emovur.
- Emovur reserves the right to modify pricing or plan structures with prior notice.
No Refund Policy:
- Refunds will not be provided in any case, including but not limited to:
- Number blocking, suspension, or restrictions by Meta.
- Partial use or non-use of the Service.
- Customer-side technical or operational issues.
- Refunds will be processed only if explicitly communicated and approved by Emovur in writing.
5. Confidentiality and Data
- We respect your privacy. All data and information shared with us—whether for marketing, consulting, or platform usage—is treated as confidential. For more, please see our Privacy Policy.
- Emovur respects your privacy. We do not misuse, sell, or share your customer data with third parties, except as required to provide the Service or comply with legal obligations.
- You retain ownership of your data stored within our systems.
- Upon termination or migration, you may request for data deletion, and we will permanently remove your data from our systems within a reasonable period.
- We implement commercially reasonable security measures to protect your data against unauthorized access or disclosure.
6. Limitation of Liability
While we strive to deliver high-quality and secure services, Emovur is not liable for:
- Losses arising from incorrect client data or third-party platform issues.
- Downtime or service interruptions due to external factors or maintenance.
- Indirect or consequential damages related to your business performance.
- While we strive for continuous uptime, temporary service interruptions may occur due to maintenance, updates, or factors beyond our control.
- Emovur does not guarantee uninterrupted or error-free operation.
- Any downtime caused by Meta or third-party APIs does not constitute a failure of our Service.
- Indirect, incidental, or consequential damages.
- Losses arising from Meta's platform restrictions, policy changes, or number suspensions.
- Any claim exceeding the amount paid by you in the last billing cycle.
7. Termination
We reserve the right to suspend or terminate services in the case of:
- Breach of these terms
- Non-payment
- Misuse of our services or tools
- You may cancel your subscription anytime by notifying us in writing.
- Emovur may suspend or terminate your account if you violate these Terms or engage in unlawful activities.
- Upon termination, your access will be disabled, but you may request data export or deletion.
- Clients may cancel subscriptions with prior written notice as per the service agreement.
8. Governing Law
These Terms and Conditions are governed by the laws of India. Any disputes will be subject to the jurisdiction of the courts of Bengaluru, Karnataka.
We may modify these Terms from time to time. Continued use of the Service after updates constitutes your acceptance of the revised Terms.
9. Use of WhatsApp Business API
- Your use of WhatsApp Business API must comply with Meta's policies and guidelines.
- Emovur acts only as a technical service provider; any restrictions or actions taken by Meta (including number blocking, suspension, or limitation) are outside our control.
Important Notes:
- If a number associated with your WhatsApp Business Account is blocked or restricted by Meta, your subscription with Emovur will remain active.
- Any limitations imposed by Meta shall not be considered as product limitations or service failure on Emovur's part.
